Virginia Sickness and Disability Program (VSDP) - Personal Sick Leave
If you were hired on or after January 1, 1999, you are automatically enrolled in the state's Virginia Sickness and Disability Program (VSDP) which provides several types of non-accruing leave each year. Participants' sick leave does not carry over at the end of the leave year, nor are participants paid for any unused sick leave when terminating employment. The state's leave year runs from January 10 through January 9 of the following year.
The first type of leave provided is Personal Sick Leave. This leave is for employees to use for their personal sick leave absences due to illnesses, injuries, and preventive, well-patient doctors' visits. An employee may also use 33% of their credited sick leave for family purposes, if qualified under the Family and Medical Leave Act Policy. The amount of sick leave credited during the first year of employment for newly-hired employees depends on whether they are full-time or part-time and is based on their first date of employment, as shown in the chart below.

Virginia Sickness and Disability Program (VSDP) - Family and Personal Leave
Traditional Sick Leave
Employees hired prior to January 1, 1999 who opted to stay in the Traditional Sick Leave Program instead of enrolling in the Virginia Sickness and Disability Program (VSDP) and who again opted to stay in the Traditional Sick Leave Program after January 1, 2003, accrue sick leave which carries forward into each new year unconditionally.
Full-time classified employees in the Traditional Sick Leave Program accrue sick leave at the rate of five (5) work hours for each completed semi-monthly period of service he or she works provided no leave without pay is taken during a pay period. Part-time, classified employees must work at least 20 hours per week to earn sick leave, and will accrue sick leave at a rate proportionate to the number of hours worked each week.
Employees are allowed to use their accrued sick leave to take time off from work for the following reasons: (1) if medically necessary, during an employee's temporary disability from performing his or her duties, including disability related to pregnancy or childbirth; (2) if an employee has, or has been exposed to, a contagious disease such that his or her presence on the job might jeopardize the health of others; and (3) if an employee's medically-related appointment(s) cannot be scheduled during his or her non-work hours.
Additionally, employees also are allowed to use their accrued sick leave to take time off from work for the illness or death of an immediate family member. The maximum amount of family sick leave that an employee may use is: (1) 24 work hours for any one illness, injury or death; and (2) 48 total work hours in a calendar year.
